2 Accepting these terms

By creating an account, subscribing, or using Bakelytics, you accept these terms, the Delivery Policy and the Refund and Cancellation Policy. All three together form one agreement. If you do not accept them, do not use the service.

If you subscribe on behalf of a business, you confirm that you are authorised to bind that business, and “you” means both you and it.

3 What the service is

Bakelytics is a hosted web application for costing and production record-keeping in a small food business. It records supplier purchases, tracks pantry stock as dated lots, holds recipe versions, guides a production session, captures real weights and yields, and reports what a batch cost and what margin it earned.

Bakelytics is a record-keeping and calculation tool. It is not accounting, tax, legal, food-safety or financial advice. Every figure it shows is computed from data you enter. If a purchase price, a quantity, a unit conversion or a weight you captured is wrong, the cost and margin derived from it will be wrong. Where the service cannot compute a cost honestly it says so and withholds the figure rather than estimating it, but you remain responsible for the accuracy of your own records and for the pricing, tax and business decisions you take.

4 Your account

  • You must give accurate registration details and keep them current.
  • You are responsible for your login credentials and for everything done through your account. Tell us immediately at bakelytics@rasworx.com if you believe it has been used without your permission.
  • One account represents one business. You may not resell, sublicense or share access with a business that is not yours.
  • You must be at least 18 years old and legally able to enter into a contract.

5 Fees, billing and payment

  • Subscription fees are the amounts displayed or quoted to you at the time you subscribe, in South African Rand (ZAR).
  • RasWorx Systems (Pty) Ltd is not registered for VAT. No VAT is added and the amount shown is the amount charged.
  • Subscriptions are billed monthly in advance and renew automatically each month until you cancel.
  • Payments are processed by Payfast by Network (Pty) Ltd. We do not receive or store your full card details. Your use of the payment provider is also subject to that provider’s own terms.
  • If a payment fails, we may retry it and may suspend access until the account is brought up to date. Your data is not deleted on suspension.
  • We may change our fees. We will give you at least 30 days’ notice by email before a change applies to your subscription, and you may cancel before it takes effect.

6 Delivery of the service

Bakelytics is delivered electronically and there are no physical goods, no shipping and no delivery charges. How and when access is provided is set out in full in the Delivery Policy.

7 Cancellation and refunds

You may cancel at any time. Cancellation stops the next renewal and your access continues until the end of the period you have already paid for. Fees already paid are not refunded on a pro-rata basis. The full position, including your statutory rights and the cases where we do refund, is set out in the Refund and Cancellation Policy.

8 Acceptable use

You may not:

  • use the service for anything unlawful, or to store unlawful content;
  • attempt to gain access to another customer’s data, or to any part of the system you have not been granted access to;
  • probe, scan, overload, or interfere with the service or the infrastructure it runs on;
  • copy, decompile or reverse-engineer the software, or build a competing product from it;
  • resell, rent out or otherwise commercially exploit access to the service without our written permission.

We may suspend or close an account that breaches this clause. Where the breach is not serious and can be fixed, we will ask you to fix it first.

9 Your data

Your business data stays yours. Recipes, supplier prices, purchases, production records and everything else you enter belong to you. You grant us only the permission needed to host, process, back up and display that data so the service can work.

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013. Both the export and the closure are yours to do without asking: the account page inside the product downloads every record of your business as one file, and it is also where an account is closed. You can still write to bakelytics@rasworx.com if you would rather we did it.

Records that make a cost traceable — purchases, stock movements, production sessions and the cost snapshots derived from them — are kept for as long as the business exists, because a cost figure without the evidence behind it cannot be audited. There are three ways to close, and they do different things to those records. If you leave the business, or hand it to somebody else, your sign-in ends and the records stay; a business with nobody left in it becomes dormant, reachable only by an operator of ours and not reopenable from the product. If you delete the business, it and every record beneath it go with your account, and that cannot be undone. The account page says which is which before you choose. Copies may persist in our hosting provider’s backups for that provider’s own retention period.

The demo. The free demo bakery is a private, fictional copy of a business, opened with an anonymous sign-in and no payment. Its figures are invented and are not advice. Nothing you enter in it is a customer record, and it is not a trial that carries over into an account. It is deleted after 24 hours, or sooner if you start over or sign out of it, and it cannot be exported or recovered. Please do not enter real personal or business information into it.

10 Availability

We aim to keep Bakelytics available and working, but we do not promise uninterrupted or error-free service. Access may be unavailable during maintenance, during a failure at a third-party provider we depend on, or for reasons outside our control.

Parts of the application are designed to keep working on an unreliable connection, but any action that changes a stock balance requires a connection on purpose — a balance that moves while the record is out of reach is a balance nobody can trust afterwards.

11 Our intellectual property

The Bakelytics software, its interface, its documentation and the Bakelytics name and logo remain our property. Your subscription is a licence to use the service for your own business for as long as it is paid up. It transfers no ownership.

12 Limitation of liability

Nothing in these terms excludes any liability that cannot lawfully be excluded, including liability for fraud, for death or personal injury caused by our negligence, or any right you have under the Consumer Protection Act 68 of 2008 where it applies to you.

Subject to that: the service is provided as it stands; we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss arising from decisions you took on the basis of figures the service produced from data you supplied; and our total liability to you in connection with the service in any twelve-month period is limited to the subscription fees you actually paid us in that period.

You are responsible for keeping your own copies of business records you are required by law to retain.

13 Suspension and termination by us

We may suspend or terminate your access if you materially breach these terms, if your account is unpaid, or if we are required to by law. If we terminate an account that is paid up and not in breach — for example if we discontinue the service — we will give you reasonable notice, an opportunity to export your data, and a refund of the unused portion of any fee you have paid in advance.

14 Changes to these terms

We may update these terms. The effective date at the top of this page always reflects the current version. For a change that materially affects your rights, we will give you at least 30 days’ notice by email before it applies to you. Continuing to use the service after a change takes effect means you accept the updated terms.

15 Governing law and disputes

This agreement is governed by the law of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from it.

Please raise a complaint with us first, at bakelytics@rasworx.com. We will acknowledge it within 2 business days and aim to resolve it within 10 business days. Most problems are settled faster this way than through any formal process.
